Purpose

These purchase and sale conditions regulate the purchase and sale between the User, as the buyer, and GEOMETRIKTARGET, as the seller, including the methods of payment and delivery conditions of the goods.

The Customer and the Purchaser accept these General Sale Conditions, which are for general application, unless an express and written derogation is provided by GEOMETRIKTARGET.

 

Intellectual Property

GEOMETRIK is the owner of this website. Unless otherwise stipulated, GEOMETRIK and/or its partners/suppliers are the proprietors of all the content (trademark logos, design, photography and presentations), which are protected by the industrial and intellectual copyright regulations. No content can therefore be modified, reproduced, published or distributed without prior permission from GEOMETRIK.

 

Consumer and Professional Customer

The term “Consumer” refers to an individual person who, with respect to the current conditions, predominantly acts outside the scope of his/her commercial, industrial, handicraft or professional activity.

The term “professional customer” refers to an individual User or company that acts/purchases within the scope of his/her professional activity.

The expression “User” refers to both Consumers and Professional Customers indiscriminately.

When analysing these general sale conditions, it should be taken into account that different regimes may be in place for consumers and professional customers, and the conditions that are applicable should always be checked.

 

Order

Users can ask for information or a quote through this website, or by sending an email to info@geometriktarget.com.

To ask for information or a quote, users should provide certain personal data, such as an e-mail address, name and telephone number, filling in all the mandatory fields of the form.

GEOMETRIKTARGET will only be bound to fulfil an order if, after the User contacts our sales team and it sends the user the requested quote, the user confirms the general sale conditions and the prices of the articles, saying he/she accepts them in writing and paying the total amount of the order. Only after all these requirements have been met will the order be validated by GEOMETRIKTARGET and duly processed.

In the event of unconfirmed payment, incomplete or incorrect orders or non-compliance with any of the sale terms and conditions, Geometrik reserves the right not to accept the user’s order, or to cancel the order totally or partially, even after it has been confirmed. In this case the user shall be notified by email that the sale contract was not fulfilled and that the seller did not carry out the sale, specifying the reasons why.

All the products/equipment are subject to pre-payment. Dispatch/delivery will only be carried out after confirmed collection of the full amount for the order. GEOMETRIKTARGET may refuse to fulfil the order if the USER owes any outstanding amount.

Even after confirmation of the order, GEOMETRIKTARGET reserves the right to cancel under the following conditions, and is exempt from liability for any damages or costs:

– The product is not available in stock;
– The information on the invoice is not correct or verifiable;
– The order is flagged by our Safety Systems as an incorrect order or an order likely to be a fraud;
– If the payment for the order has not been received within 30 days of acceptance of the order;
– When it is impossible to deliver the order to the address supplied by the User;
– If it is deemed that the user does not have the capacity to carry out the act.

 

Liability

All the Products presented on the website are in compliance with Portuguese legislation.

Geometrik is not liable for damages arising from interference, interruptions, IT viruses, breakdowns or disconnections of the operating system that may temporarily prevent access, navigation or provision of services to the User.

Geometrik refuses to accept any liability for any delay or impossibility in processing the order, namely as regards the delivery due to erroneous or insufficient information provided by the User. Likewise, Geometrik cannot be held responsible for the non-fulfilment of its obligations when it is imputable to an unforeseeable or insurmountable fact attributable to a third party, or a force majeure event.

Geometrik cannot be held responsible for damages incurred as a consequence of improper use of our products.

In completing any transaction with GEOMETRIKTARGET, the User accepts these general conditions and expressly recognises that the trademarks and product models supplied by GEOMETRIKTARGET are the exclusive property of the company. The User shall not dispute their ownership, or use, copy or disclose any such trademarks, in any way or by any means, unless expressly authorised to do so in writing by GEOMETRIKTARGET.

 

Total Agreement

These general conditions comprise the complete agreement between the User and Geometrik.

What is alternative dispute resolution?

Alternative dispute resolution is the opportunity all consumers have to use official authorities to help them in the resolution or guidance of a dispute, before taking Court action.
