When the Consumer activates the legal guarantee for non-compliance, Geometrik will check the goods after receiving them at our premises. If the non-compliance is confirmed, the consumer can choose between repair or replacement of the product, unless the option selected to rectify the non-compliance is impossible, or the option chosen gives rise to disproportionate costs for Geometrik compared to the other option.
If both the repair and the replacement are impossible, or give rise to disproportionate costs for Geometrik, the company may refuse both solutions. In this case the consumer can opt for:
1 – a reduction in price proportional to the reduction in the value of the products received compared to their value if they were in compliance.
2 – or the rescission of the contract, although this option is not available when the non-compliance is minimal.
In cases where the non-conformity occurs within 30 days of delivery of the product, the consumer may request immediate replacement of the product or rescission of the contract.
These rights expire after two years counting from the date the non-conformity is communicated, notwithstanding any causes of suspension to the time limit that may occur under the legal terms.
For the purpose of repair or replacement, the consumer shall supply the products, at Geometrik’s expense. In the event of repair, the product will have an additional guarantee period of six months for each repair up to a limit of four repairs.
If the Consumer is owed a refund, the method of payment used will be the same method used by the consumer in the initial transaction, unless otherwise stated.
If the inspection by Geometrik concludes improper use of the product occurred, and/or an event that could have caused the defect or poor functioning of the article (e.g. a fall, cuts, improper maintenance), the user must collect the article from our premises or pay the respective delivery costs.
The products presented may not exactly match the actual product in terms of image and colours, owing to the browser and/or monitor used. Furthermore, variations may occur given that they are recycled products or from different production cycles. These variations do not affect the performance or use of the product at all.
Orders of goods produced in accordance with the user’s specifications or obviously customised cannot be cancelled, as they begin to be produced straight after the order is confirmed.
The right to free rescission of the contract outlined in this section only applies to Customers categorised as general customers and for contracts made online. For products that are not produced as per the General Consumer’s specifications or which are obviously customised, and which are acquired online, the Consumer is entitled to rescind the contract within 14 (fourteen) days of receiving the products, without having to give any reason.
The time limit for exercising this right expires 14 days after the products are physically in the possession of the consumer or a third party delegated by the consumer, which is not the transport company, or in the case of an order with several goods, on the day after the last product is physically in the possession of the consumer or a third party delegated by the consumer, which is not the transport company.
After exercising the right to free rescission, the consumer must inform us of their decision to rescind the contract by means of an unequivocal declaration (e.g. by Email: firstname.lastname@example.org, or by post to the address: GeometrikTarget, Rua 1º de Maio Zona Industrial do Roligo, 161a, 4520-115 Espargo, Santa Maria da Feira;). In order to respect the withdrawal period, the communication sent to exercise the right to free rescission must be sent before the end of the rescission deadline.
In the event of the right to free rescission of the contract, the Consumer shall be refunded all the payments made, apart for any surplus costs resulting from choosing a delivery method different from the method provided by GEOMETRIK (collection from our warehouse), without any unjustified delay, and in any event at the latest 14 (fourteen) days counting from the date GEOMETRIK was informed of the Consumer’s decision to rescind the contract. These refunds shall be made using the same method of payment used by the customer in the initial transaction, unless expressly otherwise agreed; in any event, no costs shall be incurred as a consequent of the refund.
We may retain the refund until the returned goods have been received. The goods should be returned or handed to us without unjustified delay within 14 days counting from the day we are informed of the contract rescission. This deadline is considered respected if you return the goods before the end of the 14-day period.
The Customer shall bear the direct costs of returning the products, i.e. the fee charged by the delivery services, and shall only be responsible for any product depreciation caused by manipulation that exceeds what is necessary to check the nature, characteristics and functioning of the products.
The exercising of the right to free rescission depends on confirmation of the following conditions:
If the inspection carried out by Geometrik results in signs of improper use, and/or the problem that may have caused the defect or incorrect functioning of the article (e.g. a fall, cuts, improper maintenance), the user loses the right to free rescission and must collect the article from our premises, or bear the respective delivery costs.
Among the other costs outlined by Law, products ordered as per the Consumer’s specifications or which are obviously customised cannot be subject to free rescission of the contract. These kinds of articles can only be returned if they have defects or are non-compliant in relation to what was ordered.
